Building In A Flood Zone: Building Regulations, Extensions And Flood Resilient Construction
Building in a flood zone in England is controlled mainly through planning, not Building Regulations. Planning decides whether the work is allowed and sets floor levels and flood resistance, usually through a flood risk assessment that follows Environment Agency standing advice.

What Do Building Regulations Require For Building In A Flood Zone?
Building Regulations do not require flood resistance. Approved Document C states: "Flood resistance is not currently a requirement in Schedule 1 of the Building Regulations 2010 (and amendments)." Flood-specific requirements for new building work come from planning policy and the Environment Agency's standing advice, not from Building Regulations.
Building Regulations still matter in three ways:

What Does Building An Extension In Flood Zone 2 Or 3 Involve?
Building an extension in Flood Zone 2 or 3 involves a flood risk assessment, but for a minor extension a short one following the Environment Agency's standing advice. A minor extension is a household or non-domestic extension with a floor space of no more than 250 square metres. Householder extensions are exempt from the sequential test.
The steps for a minor extension:
- Confirm the Flood Zone and any surface water risk on the Flood Map for Planning.
- Get the estimated flood level. The design flood is a river flood with a 1 in 100 annual probability plus an allowance for climate change; a tidal flood with a 1 in 200 annual probability plus an allowance for climate change. The Environment Agency may supply it; otherwise a specialist calculates it.
- Set the floor level. We recommend floor levels are set at least 600 millimetres (mm) above the estimated flood level. You may be able to reduce this to 300mm if there is a high level of certainty about your estimated flood level.
- If floor levels cannot be raised, add flood resistance and resilience measures to at least 600 mm above the estimated flood level.
- Check other consents if the work is within 20 metres of a main river or flood defence.
- Submit the FRA with the planning application.
In Flood Zone 3b, the standing advice points to the compatibility table: development should not be permitted in Flood Zone 3b if its vulnerability classification is: 'highly vulnerable' 'more vulnerable' 'less vulnerable'. The full list of FRA triggers is in flood risk assessment.
Which Building Work Needs Which Approvals In Each Flood Zone?
The approval route depends on the type of work and the Flood Zone: a flood risk assessment, the sequential test, the exception test, or refusal. The matrix below applies national policy to common projects; it assumes planning permission is required and the site has no other flood risk triggers.

"No FRA" assumes no Flood Zone 1 trigger such as surface water risk, critical drainage problems or future river or sea risk. Changes of use to caravan, camping, chalet, mobile home or park home sites are not exempt from the sequential test.

How Do You Build A Flood Resilient Home?
You build a flood resilient home by first keeping water out where it is safe to do so, and then designing the building to recover quickly if water gets in. National planning policy requires development at flood risk to be appropriately flood resistant and resilient such that, in the event of a flood, it could be quickly brought back into use without significant refurbishment.
The Environment Agency's standing advice for vulnerable development sets these standards:

Two points of principle from the same advice: Internal flooding of new vulnerable development like residential dwellings is unlikely to be considered appropriately flood resistant and resilient. And the relevant British Standards are BS 851188-1:2019+A1:2021 (installation and retrofit of resistance measures); BS 85500:2015 (speeding recovery after a flood); BS 8102:2022 (water entering below ground structures such as basements).

Can You Build A Basement In A Flood Zone?
You can build a basement dwelling in Flood Zone 1, and in Flood Zone 2 only if it passes the sequential and exception tests; in Flood Zones 3a and 3b it should be refused. Basement dwellings are classed as highly vulnerable in the NPPF's Annex F.
What applies to any basement in a flood risk area:
- Vulnerability. A basement used as a dwelling is highly vulnerable, the most restricted of the five classes.
- Escape. The standing advice requires that any basement rooms have clear internal access - for example a staircase to an upper floor above the estimated flood level.
- Waterproofing. The British Standard for water from the ground entering below-ground structures is BS 8102:2022.
- Groundwater. Basements are especially exposed to groundwater flooding; see groundwater flooding.
What Does A Change Of Use Do To Your Flood Risk Obligations?
A change of use can raise the building's vulnerability classification, which may bring in a flood risk assessment and, in the highest-risk zone, refusal. Most changes of use are exempt from the sequential test, and therefore the exception test, but not from the compatibility table or the duty to be safe.
How it works under the NPPF:
- The vulnerability can rise. Converting offices (less vulnerable) to flats (more vulnerable) moves the building into a stricter class; see the vulnerability classification.
- An FRA is needed in Flood Zones 2, 3a and 3b, and in Flood Zone 1 where the change that increases the vulnerability classification and may be subject to sources of flooding other than rivers or sea.
- The sequential test does not apply, except for changes of use to caravan, camping, chalet, mobile home or park home sites.
- Incompatible uses are still refused. Development proposals should be refused if the use is incompatible with the risk from river or sea flooding, as set out in Annex F, table 3. Homes in Flood Zone 3b fall into this.
- Even without a class change, risk can rise. The Planning Practice Guidance notes that the sub-division of a home into a series of flats may introduce more people or confine dwellings to the ground floor.
- On the coast, New residential development (including through changes of use) is inappropriate within an area to which this policy applies, unless it meets that policy's tests.
